The Housing (Scotland) Bill
Scotland already has some of the strongest tenant protections in the UK following the Private Housing (Tenancies) (Scotland) Act 2016. The Housing (Scotland) Bill, expected to come into force in 2026, goes further — introducing new rules on rent control, eviction grounds, and landlord registration.

Key Changes for Landlords
Rent Control Areas
High ImpactLocal authorities will be able to designate Rent Control Areas where landlords cannot increase rents beyond a set percentage. Edinburgh City Council is expected to apply. Landlords should be aware that rent increases may be capped, even between tenancies in some circumstances.
Eviction Grounds
High ImpactChanges to the grounds on which landlords can end a tenancy are expected. The bill proposes new and amended grounds, including requirements to demonstrate genuine intention to sell or refurbish — with longer notice periods in several cases.
Stronger Tenant Rights
Medium ImpactTenants will have enhanced rights to request pets, to personalise their home, and greater protections against retaliatory actions by landlords following complaints or repair requests.
Landlord Registration
Medium ImpactEnhanced requirements around landlord registration are expected, with greater scrutiny of landlords who have previous compliance failures.

Low ImpactSeparate provisions affect social landlords and housing associations — less directly relevant to private landlords but part of the same legislative package.

Right to Keep Pets
Tenants will have a stronger right to request to keep pets, and landlords must have a reasonable grounds to refuse.
